This End User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and Reel-Smart – Your AI Fishing Companion ("Reel-Smart," "we," "our," or "us") governing your use of the Reel-Smart mobile application, website, and related services (collectively, the "Application").

By downloading, installing, accessing, or using the Application, you agree to be bound by this EULA. If you do not agree, do not install or use the Application.

For users who download the Application through the Apple App Store, this EULA supplements Apple's Standard Licensed Application End User License Agreement (LAEULA). If any provision of this EULA conflicts with Apple's mandatory terms, Apple's terms will control to the extent of that conflict.

1. License Grant

Subject to your compliance with this EULA, Reel-Smart grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install the Application on devices you own or control.
• Use the Application for your personal, non-commercial fishing activities.
• Access features made available through your subscription or account.

No ownership rights are transferred to you.

2. License Restrictions

You may not:

• Copy or redistribute the Application.
• Sell, lease, rent, sublicense, or commercially exploit the Application.
• Modify or create derivative works.
• Reverse engineer, decompile, or disassemble the Application except where expressly permitted by applicable law.
• Remove copyright or trademark notices.
• Attempt to bypass security or subscription features.
• Use the Application for unlawful purposes.
• Interfere with servers, networks, or other users.

3. User Accounts

Certain features require an account.

You agree to:

• Provide accurate information.
• Maintain the security of your credentials.
• Be responsible for activity occurring under your account.
• Notify us immediately of unauthorized account use.

4. Premium Subscription Features

Premium subscriptions may include features such as:

• Unlimited AI fish identification
• Fish length estimation
• Fish weight estimation
• Unlimited catch history
• Cloud synchronization
• Offline access
• Tournament tools
• Advanced weather
• Tide charts
• Solunar forecasts
• Additional premium services introduced in future updates

Subscription billing is managed through Apple App Store or Google Play.

Subscription pricing, plans, and features may change over time.

5. Artificial Intelligence Features

The Application uses artificial intelligence and computer vision technologies to provide estimates and recommendations.

Examples include:

• Fish species identification
• Fish measurement estimates
• Estimated fish weight
• Fishing recommendations
• Environmental predictions

These features are provided for informational purposes only.

We do not guarantee the accuracy or completeness of AI-generated results.

6. Fishing Regulations

Fishing regulations vary by location and frequently change.

Although the Application may provide regulation information, you remain solely responsible for complying with all applicable federal, state, local, tribal, and international fishing laws.

Always verify regulations with the appropriate wildlife or fisheries authority before fishing or keeping any catch.

7. User Content

You retain ownership of your uploaded content, including:

• Photos
• Catch records
• Comments
• Notes

By uploading content, you grant Reel-Smart a worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, and transmit that content solely as necessary to operate, maintain, improve, and provide the Application.

You represent that you have the necessary rights to upload your content.

8. Intellectual Property

The Application, including all software, designs, graphics, logos, databases, AI models, text, and other content, is owned by Reel-Smart or its licensors and is protected by intellectual property laws.

Except for the limited license granted by this EULA, no rights are granted to you.

9. Updates

We may release updates, patches, bug fixes, or new features at any time.

Some updates may be required to continue using certain features.

Failure to install required updates may limit or disable portions of the Application.

10. Third-Party Services

The Application may integrate with third-party services, including:

• Apple
• Google
• Firebase
• RevenueCat
• Google Maps
• Apple Maps
• Weather providers
• Mapping providers
• Artificial intelligence providers
• Analytics services

Your use of these services may also be governed by their own terms and privacy policies.

11. Safety Disclaimer

Fishing and outdoor recreation involve inherent risks.

You acknowledge that Reel-Smart does not control:

• Weather conditions
• Water conditions
• Wildlife
• Navigation hazards
• Fishing regulations
• Emergency situations
• 
  

You assume all risks associated with outdoor activities.

Always exercise good judgment and use appropriate safety equipment.

12. Availability

The Application is provided on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee uninterrupted availability, error-free operation, or compatibility with every device.

Features may be added, modified, suspended, or discontinued at any time.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Application is provided without warranties of any kind, whether express or implied, including warranties of:

• Merchantability
• Fitness for a particular purpose
• Accuracy
• Reliability
• Non-infringement

We do not warrant that:

• AI identifications are accurate.
• Fish measurements are precise.
• Fishing forecasts are correct.
• The Application will operate without interruption.
• Errors will be corrected immediately.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Reel-Smart and its owners, officers, employees, affiliates, licensors, contractors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Application.

Our total aggregate liability for any claim shall not exceed the amount you paid for the Application or Premium subscription during the twelve (12) months immediately preceding the event giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless Reel-Smart, its affiliates, employees, contractors, and licensors from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:

• Your use of the Application.
• Your violation of this EULA.
• Your violation of applicable law.
• Your infringement of another person's rights.

16. Termination

This license automatically terminates if you violate this EULA.

We may suspend or terminate your access if:

• You breach this Agreement.
• Fraudulent activity is detected.
• Required by law.
• Necessary to protect the Application or its users.

Upon termination, you must stop using the Application and remove all copies from your devices.

17. Export Compliance

You agree to comply with all applicable export control and sanctions laws.

You may not use or export the Application in violation of United States or other applicable laws.

18. Governing Law

This EULA shall be governed by the laws of the state in which Reel-Smart is established, without regard to conflict of law principles, except where mandatory consumer protection laws require otherwise.

19. Apple-Specific Terms

If you obtained the Application through the Apple App Store:

• Apple is not a party to this EULA and is not responsible for the Application.
• Apple has no obligation to provide maintenance or support services.
• Apple is not responsible for any warranty claims relating to the Application.
• Apple is not responsible for claims involving product liability, legal compliance, consumer protection, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

20. Google Play-Specific Terms

If you obtained the Application through Google Play:

• Your use of the Application must comply with Google Play's Terms of Service and Developer Program Policies.
• Google is not responsible for support or maintenance of the Application.
• Purchases made through Google Play are governed by Google's billing policies.

21. Severability

If any provision of this EULA is found to be unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

This EULA, together with our Terms and Conditions and Privacy Policy, constitutes the complete agreement between you and Reel-Smart regarding your use of the Application.
